Cancellation instructions & cancellation form

Consumers are entitled to the right of cancellation according to the following conditions, whereby a consumer is any natural person who concludes a legal transaction for a purpose which cannot be primarily attributed to their commercial or independent professional activities:

Cancellation rights

You have the right to cancel this contract within fourteen days without statement of reason.

The cancellation period is fourteen days from the day that you or the third party nominated by you, who is not the carrier, took possession of the last goods.

In order to exercise your cancellation rights you must inform us (Nagel-Zude GmbH & Co. KG, Werkstraße 6, 21706 Drochtersen, Tel.: 04143-329590, Fax: 04143-3295920, email: info@1a-neuware.de) with a clear statement (e. g. a letter sent by postal mail, fax or email) about your decision to cancel this contract. You may use the attached sample cancellation form, however it is not mandatory.

To meet the cancellation period it is sufficient to send a notification about the exercise of the cancellation rights before the end of the cancellation period.

Consequences of cancellation

If you cancel this contract, then we must immediately, or at the latest within fourteen days after the day on which the notification of your cancellation of the contract was received by us, pay back to you all payments which we have received from you, including the delivery costs (with exception of any additional costs which resulted from your selection of a different type of delivery to the cheapest standard delivery offered by us). For this repayment we will use the same payment method which you used in the original transaction, unless it is expressly agreed otherwise with you; in no case will this repayment result in the payment of compensation. We may refuse this repayment until we have received the returned goods or you have provided evidence that the goods have been sent back, depending on which occurs first.

You must immediately, and in any case at the latest within fourteen days from the day on which you informed us of the cancellation of the contract, deliver or send the goods back to us. The time period is upheld if you send the goods before expiry of the fourteen day time period.

You bear the direct costs of returning the goods. The direct costs of returning goods which are unsuitable for a return shipment by post, due to their nature (goods delivered by transport agency), are estimated at around a maximum of 100,00 Euro.

You must only pay for any diminished value of the goods if this loss of value cannot be ascribed to a testing of the quality, properties and operation of the goods carried out by you and which was not necessary.

End of the cancellation instructions

General information

1. Please avoid damages to or contamination of the goods. If possible send the goods back to us in the original packaging, with all the accessories and packaging components. If necessary please use protective secondary packaging. If you no longer have the original packaging, then please ensure adequate protection from transport damages with suitable packaging.
2. Where possible please do not send the goods back to us via freight forwarding.
3. Please note that the aforementioned clauses 1-2 are not a prerequisite for the effective exercise of the right of cancellation.
